Ian Kennedy extols the virtues of self-determination by patients: they should make their own decisions about medical treatment after being given advice by their doctors; for doctors to make such decisions on their patients' behalf is authoritarian and unacceptable (I). I present a case where, despite thorough consultation and counselling, the decisions made by the patient and supported by her doctors were found to be consistently inappropriate to her changing lifestyle.

This study examines the representation of male and female musicians in world-class symphony orchestras. Personnel of 40 orchestras of three regions, UK, Europe and the USA and distributions of men and women across the four orchestral departments: strings, woodwind, brass and percussion are compared. Significant differences in representation between orchestras of the three regions are reported. Practices adopted by orchestras when appointing musicians to vacant positions are reviewed and numbers of males and females appointed to rank-and-file and Section Principals are (...) compared. Career patterns of male and female musicians are also compared. Increases in numbers of women appointed to orchestral posts in the last three decades are compared with increases in the proportion of women in the general workforce. The data of orchestral membership are then compared with the numbers of young people receiving tuition on orchestral instruments retrieved from a large national database (n = 391,000 students). Implications for the future of male and female representation in orchestral personnel are then considered. (shrink)

I tried to appeal to his other work and his systematic proclivities. Why not try like Schelling to produce a system of freedom? He looked at me queerly. I was a bit taken aback when he burst out laughing in my face, and blurted out: (...) “You must not have read Dostoevski’s Notes from the Underground!” I’m afraid he has spent too much time with the prodigals he has written about. He muttered something almost inaudible about Dostoevski’s double, but I said nothing.If I am not mistaken these pieces have to do with four great and very influential philosophers: Kant, Hegel, Marx, Nietzsche. To help the reader I have put the abbreviation K, H, M and N before each ‘monologue.’ In fact, I am not sure if the writer was mocking me: as if my sober efforts to talk of these four thinkers was being doubled with voices like and unlike; voices as if spoken from within, and yet said to have come from beyond; ego and alter; an odd twin of my scholastic sobriety. Academic dishonesty (AD) is a threat to quality education, ethics of professional practices and career outcomes. Psychopathy is connected to AD. This study investigated whether academic confidence (AC) mediates the relationship between psychopathy and AD. University students (N = 335, mean age = 18.38 years) completed measures of relevant variables, in addition to providing demographic details. Results of statistical analysis showed that AC mediated the association between primary psychopathy and AD. Considering the extent of students' belief, trust and expectation that (...) they can execute their academic tasks by themselves could be important target in enhancing ethical behaviors among students. For John M. Anderson philosophy, as the love of wisdom, is a concern for what is ultimate. The essays in this volume take to heart this understanding of philosophy, and are therefore responses to the ultimate. The first four essays by Kaelin, Schrag, Baillif and Johnstone, deal with Anderson's own account of ultimacy as it is presented in his reflections on the aesthetic occasion, the experience of the sublime, on freedom and on insight. The concern for what is ultimate is (...) formulated differently by each of the other eight essays. Desmond articulates ways of our encounter with the ultimate by means of what he calls essential perplexity. Gendlin reflects on Aristotle's characterization of thinking as an activity that is ultimate. Biemel and Lingis present death as an aspect of the ultimate. Hersch sees our loss of meaning and value as the result of our refusal of finitude and thus of our denial of the ultimate which reveals itself in this finitude. Ginsberg initiates us into the ultimacy of the human encounter that is dialogue. Verene speaks of the ultimate through his account of the fool. For Kockelmans philosophy, unlike science, deals with what-is as it manifests itself in our encounter with our lived world which is a source of meaning, and in that sense an ultimate. Finally, John M. Anderson writes of the awareness of our becoming more than we are, and does so by bespeaking the origin of the dialogue we are. (shrink)

Bernard Reginster has argued that in "Nietzsche's terminology, 'experimentation [Versuch]' is a paradigmatic exercise of curiosity."1 According to Reginster, the kind of curiosity in question, as far as Nietzsche's concept of the free spirit is concerned, is not the state of knowing or of being certain of the truth of some proposition, but is rather a matter of the activity or process of truth seeking and of inquiry.2 My own view is very similar: I have argued that experimentalism is a (...) form of virtue for Nietzsche.3 Specifically, as I have suggested, Nietzsche employs experimentalism in two main ways: as a strategy for philosophical engagement, for example through his use of diverse writing styles and authorial... Karl Popper defines an ad hoc hypothesis as one that is introduced to immunize a theory from some (or all) refutation but which cannot be tested independently. He has also attempted to explicate ad hocness in terms of certain other allegedly undesirable properties of hypotheses or of the explanations they would provide, but his account is confused and mistaken. The first such property is circularity, which is undesirable; the second such property is reduction in empirical content, which need not be. (...) In the former case, I argue that non-circularity is in any event preferable to non-ad hocness as a necessary condition for a satisfactory explanation or an explanans, as the case may be, and I try to sort out various persistent errors surrounding this comparison. In the latter case, I suggest that Popper is barking up the wrong tree, that important scientific progress sometimes does consist in just such reductions in empirical content as he proscribes. This provides a further reason for not taking ad hoc hypotheses as Popper conceives them to pose the danger for science he believes they do. (shrink)

The two principal models of design in methodological circles in architecture—analysis/synthesis and conjecture/analysis—have their roots in philosophy of science, in different conceptions of scientific method. This paper explores the philosophical origins of these models and the reasons for rejecting analysis/synthesis in favour of conjecture/analysis, the latter being derived from Karl Popper’s view of scientific method. I discuss a fundamental problem with Popper’s view, however, and indicate a framework for conjecture/analysis to avoid this problem.

My particular focus in this article is on getting clearer about what Nietzsche’s experimentalism entails. Some immediate resistance may form in response to this proposal, based on my use of the term experimentalism. As Walter Kaufmann has pointed out in a discussion of experimentalism, Nietzsche himself does not discuss his work using this concept; in the original German, Nietzsche uses the terms “Experiment” and “Versuch.”1 In light of this, two main concerns may be raised about my proposal that experimentalism is (...) worth some of our time and attention: whether it is necessary or helpful to focus discussion on yet another “ism” within Nietzsche scholarship and given that experimentalism is not Nietzsche’s.. Jean-François Lyotard is one of the most important, and complex, French thinkers of the twentieth century. Best known in the English-speaking world for his book The Postmodern Condition, the multi-faceted nature of Lyotard’s work has often been obscured by its sometimes problematic association with the postmodern. His life refuses to follow the clear trajectory common to academics in France: it stalls and hesitates, with Lyotard’s first ‘career’ consisting of fifteen years of militant Marxist political engagement. Kiff Bamford traces this (...) circuitous journey, unravelling the thrust of Lyotard’s main philosophical arguments, his struggle with thinking and his confrontation with the task of writing and thinking philosophy in a different way. These all take place within a series of very particular contexts: the Algerian war, the experimental university at Vincennes and a sustained engagement with the visual arts. Lyotard’s own tentative reflections on his intellectual life help to frame his suspicions of easy narratives and highlight his rejection of ‘the delusion that we are able to programme our life’. It is by following these cautions that Kiff Bamford is able to present a compelling portrait of a challenging subject. (shrink)

Any study of the 'Scientific Revolution' and particularly Descartes' role in the debates surrounding the conception of nature (atoms and the void v. plenum theory, the role of mathematics and experiment in natural knowledge, the status and derivation of the laws of nature, the eternality and necessity of eternal truths, etc.) should be placed in the philosophical, scientific, theological, and sociological context of its time. Seventeenth-century debates concerning the nature of the eternal truths such as '2 + 2 = 4' (...) or the law of inertia turn on the question of whether these truths were created along with nature, or were uncreated and subsisting in God's mind. One's answer to that question has direct consequences for conceptions of the necessity/contingency of mathematical and natural knowledge, how knowledge of such truths is accomplished by humans, and what grounds these truths. In this paper, I review the positions of four successors to Descartes' philosophy on the question of the eternal truths to illustrate how in specific ways that question with its theological, metaphysical, modal, and epistemological dimensions concerned the objectivity and certainty of the discoveries of the new science. Lyotard’s references to film and video are so limited, it should be relatively easy to expand his repertoire and consider his thoughts in relation to those of my own. But I have struggled, and skirted round my chosen topic for too long; how can his ideas be brought to play productively to my own ends – to consider the relationship of performance art to film? Perhaps that is the problem: I have sought a productive return on my investment, rather than (...) light that match simply to watch it burn. Listen to me, then, as I set fire to the skin of the film and confront the tangled mess of melted celluloid: after the performance. This original study offers a timely reconsideration of the work of French philosopher Jean-François Lyotard in relation to art, performance and writing. How can we write about art, whilst acknowledging the transformation that inevitably accompanies translations of both media and temporality? That is the question that persistently dogs Lyotard's own writings on art, and to which this book responds through reference to artists from the recently-formed canon of performance art history, including the myths of seminal figures Marina Abramovic and Vito (...) Acconci, and the controlled documentation of Gina Pane's actions. Through the unstable, untranslatable element that Lyotard calls the figural, his thought is brought to bear on attempts to write a history of performance art and to question the paradoxically prescriptive demand for rules to govern 're-performance'. Kiff Bamford contextualises Lyotard's writings and approach with reference to both his contemporaries, including Deleuze and Kristeva, and the contemporary art about which they wrote, whilst arguing for the pertinence of Lyotard's provocations today. Abstract:I raise several concerns with Earp and colleagues' analysis of enhancement through neurochemical modulation of love as a key issue in contemporary neuroethics. These include: (i) strengthening their deflation of medicalization concerns by showing how the objection that love should be left outside of the scope of medicine would directly undermine the goal of medicine; (ii) developing stronger analysis of the social and political concerns relevant to neurochemical modulation of love, by exploring and suggesting possible counters to ways in which (...) 'wellbeing' may be used as a tool of oppression; (iii) providing reasons to support a broad need for ecological investigation of, and indeed ecological education concerning, neurotechnology; (iv) suggesting ways in which philosophy, and the humanities more broadly, remain directly relevant to responding effectively to issues in contemporary neuroethics. The function or intended use of a device such as a fire escape is escape from fire, whether or not it is ever actually used as such or it acquires other uses. Biological function, on the other hand, depends, in one way or another, on actual use. Philosophical attempts to explain artifact function by analogy with biological function or to build a unified theory of function are nonetheless common. What such attempts routinely overlook, however, is the role of forethought in (...) intentional function. I defend the traditional intended use view of function, emphasize the role of forethought and argue that design intentions are rationally grounded in a design brief, for which there is no obvious natural analogue. Knowledge of residual perturbations in the orbit of Uranus in the early 1840s did not lead to the refutation of Newton's law of gravitation but instead to the discovery of Neptune in 1846. Karl Popper asserts that this case is atypical of science and that the law of gravitation was at least prima facie falsified by these perturbations. I argue that these assertions are the product of a false, a priori methodological position I call, 'Weak Popperian Falsificationism'. Further, on the (...) evidence the law was not prima facie false and was not generally considered so by astronomers at the time. Many of Popper's commentators presuppose WPF and their views on this case and its implications for scientific rationality and method suffer from this same defect. (shrink)

Here I argue that aspects of Nietzsche's thought may be productively compared with the role played by the concept of ubuntu in talk of cultural renaissance in South Africa. I show that Nietzsche respects and writes for humanity conceived of in a vital sense, thereby imagining a sense of authenticity that may prove significant to talk of cultural renaissance in South Africa. I question the view that Nietzsche is an individualist, drawing on debate between Conway (1990) and Gooding-Williams (2001), concerning (...) the interpretation of ‘The Dance-Song' in Thus Spoke Zarathustra, as well as on the notion of reciprocity intrinsic to the concept of ubuntu (Shutte, 1993). Philosophers expend considerable effort on the analysis of concepts, but the value of such work is not widely appreciated. This paper principally analyses some arguments, beliefs, and presuppositions about the nature of design and the relations between design and science common in the literature to illustrate this point, and to contribute to the foundations of design theory.

Some people have engaged in acts of civil disobedience to protest against the climate policies of their governments and corporations. This article argues that these disobedient actions are justified at present since governments fail to do all they reasonably can to respond to this pressing issue.

The received view of an ad hochypothesis is that it accounts for only the observation(s) it was designed to account for, and so non-ad hocness is generally held to be necessary or important for an introduced hypothesis or modification to a theory. Attempts by Popper and several others to convincingly explicate this view, however, prove to be unsuccessful or of doubtful value, and familiar and firmer criteria for evaluating the hypotheses or modified theories so classified are characteristically available. These points (...) are obscured largely because the received view fails to adequately separate psychology from methodology or to recognise ambiguities in the use of ''ad hoc''. (shrink)

He asserts that evidence can be used non-inductively to prefer the principle that corroboration is more successful over all human history than that, say, counter-corroboration is more successful either over this same period or in the future. Watkins's argument for rejecting the first counter-corroborationist alternative is beside the point. However, as whatever is the best strategy over all human history is irrelevant to the pragmatic problem of induction since we (...) are not required to act in the past, and his argument for rejecting the second presupposes induction. This article presents an argument for a new form of tax calculation. Firstly it is argued that Hypothetical Insurance is the best method to determine the correct type of distributive policies and the precise amounts that should be redistributed. Hourly averaging is then presented as a new candidate policy for both assisting the less economically fortunate and taxing the more economically fortunate. The article then argues that hourly averaging compares favourably against rival policies as a hypothetical insurance choice.

I argue that moral intuitions about Nietzsche as an exemplar of practical cruelty can be overturned. My argument is based upon the possibility of abandoning the notion of pure and unmediated passivity as intrinsic to the phenomena of human suffering and of Mitleid, as identified by Nietzsche. I claim that wrongly identifying intrinsic passivity in the phenomenology of Mitleid and of suffering generates the moral sceptical intuition. Once this case of mistaken identity is uncovered, 1 suggest, there is no reason (...) to remain subject to the force of the intuition. I support my account with a fresh reading of 'The Ugliest Man', from Book IV of Nietzsche's Thus Spoke Zarathustra. (shrink)

This paper argues that international citizens can retain their obligations to past states and societies, and that this obligation has implications for their state of residence. While some people remain in the same state for their entire lives, international individuals generate relationships with more than one state. The paper presents the argument that individuals are obligated to their state for at least one reason. One particularly relevant implication of this obligation is the duty to pay taxes. In regard to international (...) individuals, these considerations apply to states with which they had historic relationships as well as the state in which they currently reside. The paper offers a rough proposal as to how to calculate the relative relationship that an international individual has with their past and present states and societies. This can be used to determine what proportion of a person’s total lifetime tax revenue should be shared. Although the analysis here is presented in terms of the duty of the individual towards past states, the individual need not change their behaviour to discharge the duty. The duty impacts on current states, which should acknowledge the duty of their international resident, and make sure that this is discharged appropriately to the other relevant states. (shrink)

The discussion about relations between research and design has a number of strands, and presumably motivations. Putting aside the question whether or not design or “creative endeavour” should be counted as research, for reasons to do with institutional recognition or reward, the question remains how, if at all, is design research? This question is unlikely to have attracted much interest but for matters external to Architecture within the modern university. But Architecture as a discipline now needs to understand research much (...) better than in the past when ‘research’ was whatever went on in building science, history or people/environment studies. In this paper, I begin with some common assumptions about design, considered in relation to research, and suggest how the former can constitute or be a mode of the latter. Central to this consideration is an understanding of research as the production of publicly available knowledge. (shrink)

This paper presents a rival proposal to that presented by Dietsch and Rixen to ensure international background justice. It explains the notion of background justice and how this is challenged by the lack of international co-operation on taxation policy. It then presents the principles which Dietsch and Rixen propose in order to respond to this concern: the principle of membership and the principle of constraint. The paper proposes alternative principles of relationship and counter-incentive, which are argued to be superior means (...) to achieve the aim of global background justice. This is because the alternative principles do not interfere with the right of states to set the tax-rates that they desire. The counter-incentive approach instead rewards the states who set higher taxes and provides them with revenues from taxpayers who have left either to seek lower taxes elsewhere or for any of a number of other reasons. ABSTRACT This article, invited for presentation to the North American Nietzsche Society at the 2020 Pacific Division Meeting of the American Philosophical Association, is a commentary on Mark Alfano's 2019 monograph, Nietzsche's Moral Psychology. It critically discusses Alfano's synoptic digital humanities approach and examines the efficacy of two aspects of his argument about Nietzsche's philosophy developed using this methodology: the connection between life and will to power, and the role of speech acts.

In this paper, I aim to clarify the development of Nietzsche’s account of objectivity in his published and authorized works. In the available scholarship, it has been noted that Nietzsche explicitly differentiates between two types of objectivity. What I shall here call type 1 objectivity is the type that Nietzsche often criticizes, namely objectivity as pure disinterested. Type 2 objectivity is the type that Nietzsche refers to in On the Genealogy of Morality as “future ‘objectivity’”. Having clarified what Nietzsche’s objections (...) to type 1 objectivity are, I will explain his view of type 2 objectivity, showing how type 2 or “future ‘objectivity’” is indebted in its conception to Nietzsche’s free spirit project.
